Applicants
We are very pleased if you are interested in joining our team. In order to get a first impression of your person, your professional qualification etc. some personal information such as name, address, date of birth, contact details, education, career, nationality, residence status and certificates are required with your application.
If appropriate and permitted according to local laws and regulations, we may also need further information on your state of health.

Customers and prospects
If you are a customer or prospective customer of HWP Planungsgesellschaft, besides information on your company, we also collect personal data (such as contact details, e-mail addresses) of yourself or other persons within your company in order to provide services for you.
Your personal data are mostly given by yourself (e.g. on enquiries or orders), or they are collected by us in the course of processing, if this is necessary for handling your request or assignment.

Applicants
Your personal data is essentially given by yourself when sending application documents to us. Thereafter, you may give us further personal information in the course of a phone conversation or an application interview, which will be added to your existing file.

Customers and prospects
Your personal details are essentially given by yourself, for example through tenders, inquiries by e-mail, phone call or by contact form, or we will collect them on the initiation a legal transaction (e.g. an offer). This also applies to the processing of an assignment.

Business partners and suppliers
We mainly collect your personal information prior to the initiation of a partnership or a collaboration between us, or when engaging you as a supplier. If the contact person in your company changes, it might become necessary to collect further details on other persons within your company.

Website visitors
When visiting our website, we automatically collect your data using cookies according to the settings of your browser. For more information about cookies, including how we use them and the options you have, please refer to clause 7.
In addition, we also collect details about you when you contact us via our website, for example when you fill out a contact form or enter a comment (see also clauses 5 and 6).

We will use your personal data for the purpose of the applicant selection process.

Customers and prospects
The main reason for using your personal data is to enable mutual communication. In doing so, offers, order confirmations or delivery bills, invoices as well as other communications in the form of letters, e-mails, minutes, notes or messages are exchanged between us.
In addition, both of us have a legitimate interest in meeting the contractual agreements and thus ensure a smooth business relationship.

Business partners and suppliers
We mainly use your personal data to support mutual communications. This includes the exchange of inquiries, orders or invoices as well as other communications in the form of letters, e-mails, minutes, notes or messages between us.
In addition, both of us have a legitimate interest in meeting the contractual agreements and legal requirements and thus ensure a smooth business relationship.

1.3.4 With whom do we share your personal data?

Applicants
The received personal data are for exclusive use by our company.

Customers and prospects
The personal data we collected usually stay exclusively within our company.
In some cases, disclosure is necessary in order to negotiate special conditions with possible project partners in the context of a potential project or service provision. In such a case, the name and the contact person of your company may be passed on.
However, we usually set up an agreement with the project partner, that no further disclosure of this information takes place.

Business partners and suppliers
The collected personal data usually remain with our company.
Occasionally, the information will be handed over when negotiating special conditions with other suppliers or business partners for a potential project. In such cases, we communicate the name and the contact person of your company to them.
However, a contract processing agreement with the supplier usually prevents a further disclosure of the information.

Website visitors
Unless you have chosen otherwise, we may share information with providers of web analytic or social media services to render our website more user-friendly.

1.3.5 Transfer of personal data to third-party countries
In general, we do not transfer personal data collected via our website to countries outside the European Union or the European Economic Area (third-party countries).

However, obligations arising from mutual contracts as business or communication partners may require the data transfer to a third country. Prior to such a transmission, our appointed DPO will perform a close examination and evaluation. The data will only be transferred if the receiving body in the third country owns and proves an adequate, appropriate and secure data protection level. This is also backed up by a corresponding agreement with the recipient of the third-party country.

We ensure the protection of information, especially your personal data, by taking appropriate technical and/or organisational measures to prevent unauthorised access to your personal and other data in our company.

1.3.7 How long do we store your personal data?
Legislation has issued a variety of storage obligations and retention periods. After expiry of these deadlines, we will delete your data if they are no longer required for contractual performance or business purposes and/or due to legal requirements.
If the person in question has given written consent, we may also continue to keep the information for a prolonged time.

1.3.8 How can you access, modify or withdraw your personal data?
If we already have your personal information, you enjoy several rights. You are welcome to contact us on this and we will endeavour to process your request as soon as possible and in accordance with the legal regulations.

Consent
On certain occasions, we have to obtain your consent to the processing of your personal information depending on the activity your data is needed and intended to be used for. We explicitly ask for your consent by means of opt-ins.
Your consent has to be voluntary and the necessary actions, e.g. checkbox marking or confirmation of links received by e-mail, have to be taken by you in person. The records of your consents/refusals are kept by us.

Right to revoke consent

Right to information

In this case, we might ask you to confirm your identity or to request more information concerning your application. As far as permitted by law, we may also reject your application. Of course, you will be informed about our corresponding reasons.

Right to rectification
Naturally, you are also entitled to have your personal data corrected if they are incorrect, incomplete or have changed.

Right to cancellation
In case you claim unauthorised use of your personal data by us, you may ask us to delete them. We will respond to your request within 30 days.
Only on certain strictly defined circumstances, we will object to your request. If we agree, we will immediately delete your data.

Right to complaint
You have the right to complain to us or to the appropriate regulatory authority about the use of your personal information by us.
You can assert your claim in writing, by e-mail, phone call or in a personal conversation either directly with our company or by involving our DPO (contact details see clause 1.2.1).

1.4 Legal basis
The processing of personal data is regulated by the DS-GVO, the German Federal Data Protection Act (BDSG) as well as further German and European regulations and laws. The legal bases according to DS-GVO and BDSG we rely on when processing your data are as follows:

Article 6 DSGVO Lawfulness of processing
Subparagraph 1: Processing shall be lawful only if and to the extent that at least one of the following applies:

• Consent (Art. 6, subparagraph 1, point (a) DS-GVO):
The data subject has given consent to the processing of his or her personal data for one or more specific purposes.

• Contractual performance or pre-contractual measures (Art. 6, subparagraph 1, point (b) DS-GVO):
Processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract.

• Legal obligation compliance (Art. 6, subparagraph 1, point (c) DS-GVO):
Processing is necessary for compliance with a legal obligation to which the controller is subject.

• Legitimate own or third party interests (Art. 6, subparagraph 1, point (f) DS-GVO):
Processing is necessary for the purposes of the legitimate interests pursued by the controller or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data, in particular where the data subject is a child.

• Conclusion of employment (Art. 88 DS-GVO in connection with Sect. 26, subsect. (1), sent. 1 BDSG):
If you apply for a job online via our website, we also use your data to decide on the conclusion of an employment contract with you and, if necessary, for its implementation or termination.
